Refer to one or more details from the text to explain what Justice Brown argues to be the limitations of the Supreme Court's power. What words and phrases hint at why he feels the Court has this limit?

Answers

Answer 1

In Justice Brown's opinion in the case of Wisconsin v. Duluth, he argues that the Supreme Court's power is limited by the Constitution, or the "supreme law of the land".

What is Supreme Court?

The Supreme Court of the United States is the highest court in the country, established by the Constitution of the United States. It is the only court specifically established by the Constitution and is the ultimate authority on the interpretation of federal law. The Supreme Court consists of the Chief Justice and eight Associate Justices, who are nominated by the President and confirmed by the Senate.

He states that the Court has no power to "enlarge, abridge, or modify" the meaning of the Constitution, and that it must "abide by the established and long-recognized principles" set forth in the document. The words and phrases such as "enlarge", "abridge", "modify", and "long-recognized principles" hint at why Justice Brown feels the Court has this limit: because the Constitution is the ultimate source of power and the Court must adhere to its pre-existing principles.
